PET CHECK-IN SERVICE AGREEMENT, EMERGENCY AUTHORIZATION, RELEASE AND POLICIES

IMPORTANT NOTICE

This Agreement contains important provisions concerning:

  • Payment requirements;
  • Cancellation fees;
  • Emergency-response limitations;
  • Veterinary authorization;
  • Animal behavior;
  • Home entry;
  • Keys and security codes;
  • Other people entering the home;
  • Assumption of risk;
  • Release of certain claims;
  • Limitation of liability;
  • Indemnification; and
  • Love Furry Babies’ current lack of commercial pet-sitting insurance.

The Client must read this entire Agreement before requesting, purchasing, or receiving a Pet Check-In.

1. PARTIES AND AGREEMENT

This Pet Check-In Service Agreement, Emergency Authorization, Release and Policies (“Agreement”) is entered into between Sally Taylor, an individual operating Love Furry Babies as a sole proprietorship, referred to as “Love Furry Babies,” “Provider,” “we,” “us,” or “our,” and the individual requesting or purchasing services, referred to as “Client,” “you,” or “your.”

This Agreement applies to every Pet Check-In requested, purchased, scheduled, accepted, or performed by Love Furry Babies.

By checking the required acceptance boxes, typing your legal name, signing electronically, submitting a service request, making payment, or accepting services, you acknowledge that you have read, understood, and agreed to this Agreement.

2. DEFINITIONS

For purposes of this Agreement:

2.1 Client

“Client” means the person requesting or purchasing services and any pet owner who authorizes that person to act on the owner’s behalf.

The person completing the service forms represents that the person is at least 18 years old and has legal authority to:

  • Arrange care for the pet;
  • Authorize access to the Property;
  • Authorize veterinary assistance;
  • Accept financial responsibility; and
  • Enter into this Agreement.

2.2 Pet

“Pet” means each animal listed on the Client’s completed Pet Information Form and expressly accepted for service by Love Furry Babies.

An animal that has not been disclosed and accepted is not covered by the confirmed service.

2.3 Property

“Property” means the residence, yard, apartment, condominium, hotel room, or other approved location where the confirmed Pet Check-In will occur.

2.4 Scheduled Pet Check-In

A “Scheduled Pet Check-In” is requested and confirmed in advance for a particular date and approximate service window.

2.5 Same-Day or Non-Emergency Pet Check-In

A “Same-Day or Non-Emergency Pet Check-In” is requested because of an unexpected delay, work obligation, schedule change, convenience need, or similar circumstance that does not involve an immediate threat to a pet, person, or Property.

2.6 Emergency Pet Check-In

An “Emergency Pet Check-In” is an urgent request caused by circumstances preventing the Client from returning home as expected, such as:

  • Hospitalization;
  • An accident;
  • Vehicle trouble;
  • Severe weather;
  • Delayed travel;
  • A family emergency;
  • A work emergency; or
  • Another unexpected event.

An Emergency Pet Check-In is not veterinary treatment, animal rescue, fire response, police response, animal poison control, animal control, ambulance service, or 911 service.

2.7 Written Acceptance

“Written Acceptance” means a personalized text message or email from Love Furry Babies expressly confirming that a particular service request has been accepted.

Automated form responses, payment receipts, invoices, website messages, and payment-application notifications are not Written Acceptance.

2.8 Service Window

“Service Window” means the approximate period during which Love Furry Babies expects to arrive. Unless expressly stated otherwise in writing, a Service Window is not a guaranteed exact appointment time.

3. SERVICES COVERED

This Agreement applies to:

  1. Scheduled Pet Check-Ins;
  2. Same-Day or Non-Emergency Pet Check-Ins;
  3. Emergency Pet Check-Ins;
  4. Initial meet-and-greet appointments;
  5. Key pickup or return appointments;
  6. Additional visits requested after a confirmed service period;
  7. Pet-related household tasks included in a Written Acceptance or booking confirmation; and
  8. Any other limited pet-care service expressly accepted by Love Furry Babies in writing.

Each visit is limited to the services identified in the Client’s booking confirmation.

Services not confirmed in writing are not included.

4. PRE-ENROLLMENT AND MEET-AND-GREET REQUIREMENTS

Love Furry Babies ordinarily provides services only to Clients who have completed all required onboarding before service begins.

Required onboarding may include:

  1. An initial meet-and-greet;
  2. An introduction to every pet in the home;
  3. A completed Client Information Form;
  4. A completed Pet Information and Care Instructions Form;
  5. Disclosure of medical and behavioral conditions;
  6. Emergency-contact information;
  7. Veterinary information;
  8. A tested and approved method of home entry;
  9. Acceptance of this Agreement;
  10. Payment of all required fees; and
  11. Any additional information reasonably necessary to perform the service safely.

Love Furry Babies may decline a first-time Emergency Pet Check-In when a meet-and-greet or prior introduction has not occurred.

Love Furry Babies is never required to:

  • Enter an unfamiliar home;
  • Handle an unfamiliar animal;
  • Accept a request without sufficient information;
  • Accept a request for a pet that cannot be handled safely; or
  • Accept a request that Love Furry Babies reasonably considers unsafe.

Completion of a meet-and-greet does not guarantee that future service requests will be accepted.

5. SERVICE AREA AND AVAILABILITY

Love Furry Babies initially serves approved locations in and around Summerville, South Carolina.

The normal service area, mileage limit, and any travel fee will be determined based on:

  • The Client’s location;
  • Travel distance;
  • Travel time;
  • Traffic;
  • Road conditions;
  • Existing commitments;
  • Service availability;
  • Weather;
  • The requested arrival window; and
  • Personal safety considerations.

Being located within a stated service radius does not guarantee service or availability.

Love Furry Babies may decline or apply an additional travel fee to requests outside the normal service area.

Any travel fee will be disclosed before the booking is confirmed.

6. REQUESTS ARE NOT AUTOMATICALLY ACCEPTED

Submitting a form, sending a text message, leaving a voicemail, sending an email, receiving an invoice, or making payment does not automatically create a confirmed booking.

A request is confirmed only after Love Furry Babies provides Written Acceptance.

Love Furry Babies may decline a request because of:

  • Location;
  • Distance;
  • Availability;
  • Existing client obligations;
  • Incomplete forms;
  • Missing or uncleared payment;
  • Lack of a meet-and-greet;
  • Lack of prior introduction to the pet;
  • Pet behavior;
  • Medical complexity;
  • Unsafe Property conditions;
  • Unreliable access;
  • Severe weather;
  • Road conditions;
  • Unknown people at the Property;
  • A request outside the services Love Furry Babies provides;
  • A previous Client violation;
  • Abusive, threatening, discriminatory, or dishonest behavior;
  • An unpaid balance; or
  • Any circumstance creating an unreasonable risk.

Until Written Acceptance is received, the Client remains fully responsible for arranging other care.

7. SERVICES THAT MAY BE INCLUDED

Depending on the written booking confirmation, a Pet Check-In may include:

  • Visually checking the pet’s general condition;
  • Providing food according to written instructions;
  • Refreshing drinking water;
  • Allowing a dog into an approved secure fenced yard;
  • Cleaning a litter box;
  • Cleaning a limited pet-related accident;
  • Providing reasonable companionship and attention;
  • Checking reasonable household conditions related to pet safety;
  • Bringing in mail or a small package when agreed;
  • Providing approved basic oral or topical medication;
  • Sending a written visit update;
  • Sending photographs of the pet; and
  • Completing other limited services expressly accepted in writing.

Love Furry Babies determines whether a requested task is reasonable and safe.

8. SERVICES NOT INCLUDED

Unless separately accepted in writing, Pet Check-Ins do not include:

  • Continuous supervision;
  • Overnight care;
  • Boarding;
  • House sitting;
  • Grooming;
  • Bathing;
  • Training;
  • Veterinary diagnosis;
  • Veterinary treatment;
  • Animal rescue;
  • Routine pet transportation;
  • Public dog walking;
  • Neighborhood dog walking;
  • Off-leash activities;
  • Dog-park visits;
  • Extensive cleaning;
  • Yard maintenance;
  • Home repair;
  • Home-security patrol;
  • Handling dangerous or non-domestic animals;
  • Handling venomous animals;
  • Farm-animal care;
  • Wildlife care;
  • Administration of injections;
  • Administration of intravenous medication;
  • Administration of insulin;
  • Administration of controlled substances;
  • Complex medical treatment; or
  • Any service not confirmed in writing.

Love Furry Babies may refuse any requested task that appears unsafe, illegal, medically inappropriate, beyond the confirmed service scope, or outside the Provider’s reasonable abilities.

9. VISIT DURATION AND ARRIVAL WINDOWS

The approximate visit duration will be stated in the booking confirmation.

Visit time may include time spent:

  • Entering and securing the Property;
  • Reviewing instructions;
  • Locating supplies;
  • Attempting to administer approved medication;
  • Cleaning a limited pet-related accident;
  • Contacting the Client;
  • Managing an access problem;
  • Managing an undisclosed condition;
  • Documenting the visit;
  • Sending the visit update; and
  • Responding to an unexpected safety issue.

Unless an exact appointment time is expressly confirmed in writing, all scheduled arrival times are approximate Service Windows rather than guaranteed exact times.

Love Furry Babies may adjust the order or timing of visits based on:

  • Emergencies;
  • Traffic;
  • Weather;
  • Road conditions;
  • Pet needs;
  • Existing obligations;
  • Access delays; and
  • Personal safety.

A delay within a reasonable period does not automatically constitute a missed visit.

10. TWO-TO-FOUR-HOUR EMERGENCY RESPONSE WINDOW

For an accepted Emergency Pet Check-In, Love Furry Babies will make reasonable efforts to arrive within two to four hours.

The two-to-four-hour period begins only after all of the following have occurred:

  1. Love Furry Babies has accepted the particular request in writing;
  2. Full payment has been received and confirmed;
  3. Required forms have been completed;
  4. Current pet-care instructions have been received;
  5. Safe and working home access has been confirmed;
  6. Emergency-contact and veterinary information have been provided; and
  7. Love Furry Babies has all information reasonably needed to perform the service safely.

If payment is received before the remaining requirements are completed, the two-to-four-hour period does not begin until the final outstanding requirement has been completed.

The two-to-four-hour period is a target response and arrival window, not a guaranteed arrival time.

Arrival may be delayed by:

  • Distance;
  • Traffic;
  • Existing confirmed client obligations;
  • Severe weather;
  • Flooding;
  • Road closures;
  • Vehicle trouble;
  • Accidents;
  • Police or emergency activity;
  • Unsafe conditions;
  • Power outages;
  • Cellular or internet failure;
  • Payment-system failure;
  • Problems entering the Property;
  • Incomplete or inaccurate Client information;
  • Pet behavior;
  • Personal illness or emergency; or
  • Other circumstances outside Love Furry Babies’ reasonable control.

Love Furry Babies will make reasonable efforts to notify the Client of a significant delay when communication is available.

Love Furry Babies is not a continuously monitored or 24-hour emergency-dispatch service.

11. IMMEDIATE EMERGENCIES

The Client must not rely on Love Furry Babies when a pet, person, or Property is in immediate danger.

For an immediate or potentially life-threatening situation, the Client must contact the appropriate provider directly, which may include:

  • 911;
  • A veterinarian;
  • An emergency veterinary hospital;
  • An animal poison-control service;
  • The fire department;
  • Law enforcement;
  • Animal control;
  • A property manager;
  • A utility company; or
  • Another qualified emergency responder.

Examples include:

  • Breathing difficulty;
  • Uncontrolled bleeding;
  • Seizures;
  • Suspected poisoning;
  • Heatstroke;
  • Serious trauma;
  • Loss of consciousness;
  • Fire;
  • Gas odor;
  • Flooding;
  • Home intrusion;
  • Downed power lines; or
  • Another immediate threat.

Love Furry Babies does not guarantee that a message, text, voicemail, form, or email will be received or reviewed immediately.

12. CLIENT’S DUTY TO PROVIDE ACCURATE INFORMATION

The Client must provide complete, truthful, current, and legible information concerning:

  • Every animal at the Property;
  • Breed or type;
  • Age;
  • Approximate weight;
  • Sex;
  • Spay or neuter status;
  • Identification and microchip information;
  • Medical conditions;
  • Allergies;
  • Medications;
  • Feeding instructions;
  • Mobility limitations;
  • Hearing or vision loss;
  • Separation anxiety;
  • Escape behavior;
  • Destructive behavior;
  • Territorial behavior;
  • Fear triggers;
  • Resource guarding;
  • Bite or attack history;
  • Reactions to strangers;
  • Reactions to other animals;
  • Location of supplies;
  • Veterinary information;
  • Emergency contacts;
  • Home-entry instructions;
  • Alarm systems;
  • Cameras and recording devices;
  • Other people entering the Property;
  • Weapons;
  • Dangerous conditions; and
  • Any fact that could affect safe service.

The Client must update this information before each service whenever circumstances have changed.

Love Furry Babies may rely on the Client’s written instructions and representations.

The Client accepts responsibility for losses, delays, injuries, expenses, service failures, and emergency decisions caused by incomplete, inaccurate, misleading, outdated, or omitted information.

13. PET TEMPERAMENT, AGGRESSION AND BEHAVIOR

13.1 Mandatory Disclosure

The Client must disclose every known incident or warning sign involving:

  • Biting;
  • Attempted biting;
  • Snapping;
  • Lunging;
  • Growling at unfamiliar people;
  • Charging doors, gates, fences, or windows;
  • Territorial behavior;
  • Fear-based aggression;
  • Resource guarding;
  • Chasing;
  • Scratching;
  • Escape attempts;
  • Destructive behavior;
  • Resistance to handling;
  • Medication-related aggression;
  • Reactions to uniforms, hats, bags, noises, or movements;
  • Aggression toward another animal; or
  • Any other behavior that could reasonably affect safe service.

Disclosure is required even when the Client believes an incident was minor, unusual, provoked, or unlikely to happen again.

13.2 Right to Modify or End Service

Love Furry Babies may modify, shorten, suspend, cancel, or immediately end a visit if an animal displays threatening, unpredictable, uncontrollable, or unsafe behavior.

Love Furry Babies is not required to:

  • Corner an animal;
  • Physically restrain an aggressive animal;
  • Reach into a crate or confined area;
  • Remove a guarded object;
  • Force a collar, harness, leash, or medication onto a resisting animal;
  • Pursue an escaped animal into an unsafe area;
  • Enter a yard containing an unsecured threatening animal; or
  • Remain in a home with an animal displaying unsafe behavior.

Personal safety takes priority over completing any requested task.

13.3 Unsafe-Behavior Procedure

When reasonably possible, Love Furry Babies may:

  1. Move to a safe location;
  2. Avoid escalating the pet’s behavior;
  3. Notify the Client;
  4. Contact the emergency contact;
  5. Document the behavior; and
  6. Request that the Client or emergency contact assume responsibility.

Love Furry Babies is not required to remain at the Property while waiting for another person to arrive.

13.4 Charges and Replacement Care

A visit ended because of unsafe behavior is considered an attempted and billable visit.

The Client is responsible for arranging replacement care.

If the Client failed to disclose a previous bite, attack, escape, serious aggression, or other material safety concern:

  • The visit is nonrefundable;
  • Additional related expenses are the Client’s responsibility; and
  • Love Furry Babies may permanently refuse future services.

13.5 Pets With Bite or Serious Attack Histories

While Love Furry Babies does not maintain commercial pet-sitting liability insurance, Love Furry Babies will not knowingly accept a pet with:

  • A known bite history;
  • A serious attack history;
  • A legal dangerous-animal designation; or
  • Behavior creating an unreasonable risk.

Love Furry Babies may require veterinary records, trainer information, behavior documentation, additional safety measures, or another meet-and-greet before considering future services.

14. PET HEALTH AND VACCINATION REQUIREMENTS

The Client represents that every pet has received vaccinations required by applicable law, including current rabies protection when applicable, unless a licensed veterinarian has provided a legally valid medical exemption.

The Client must provide vaccination documentation upon request.

The Client must disclose:

  • Communicable illness;
  • Fleas;
  • Ticks;
  • Parasites;
  • Persistent coughing;
  • Vomiting;
  • Diarrhea;
  • Open wounds;
  • Recent surgery;
  • Contagious-disease exposure;
  • Significant behavioral changes;
  • Significant appetite changes; and
  • Any condition that could endanger the Provider, another person, or another animal.

Love Furry Babies may decline service for a pet that appears severely ill, contagious, medically unstable, or beyond the Provider’s safe abilities.

15. MEDICATION POLICY

Love Furry Babies will administer medication only when:

  1. Love Furry Babies has accepted the medication service in writing;
  2. Complete written instructions are provided;
  3. The medication is in its original labeled container;
  4. The pet’s name is shown on the container when prescribed;
  5. The dosage and timing are clear;
  6. The medication has not expired;
  7. The Client provides all required supplies; and
  8. Love Furry Babies reasonably believes the medication can be administered safely.

Unless Love Furry Babies agrees otherwise in writing, medication services are limited to basic oral or topical medications.

Love Furry Babies does not provide:

  • Injections;
  • Intravenous medication;
  • Insulin administration;
  • Controlled-substance administration;
  • Wound treatment;
  • Fluid administration;
  • Medical procedures; or
  • Complex medical care.

Love Furry Babies does not guarantee that a pet will swallow, absorb, or retain medication.

If a pet refuses medication, hides, vomits, spits out medication, becomes aggressive, or cannot safely be handled, Love Furry Babies may stop the attempt and notify the Client.

Love Furry Babies will not:

  • Exceed a labeled dosage;
  • Repeat a dose when it is uncertain whether the first dose was swallowed;
  • Change a medication schedule;
  • Diagnose a condition;
  • Prescribe medication; or
  • Make veterinary decisions outside the emergency authorization in this Agreement.

16. EMERGENCY VETERINARY AUTHORIZATION

16.1 Authorization to Obtain Assistance

If Love Furry Babies reasonably believes a pet may be seriously ill, injured, in distress, or require veterinary attention, the Client authorizes Love Furry Babies to take reasonable steps to obtain assistance.

Love Furry Babies will make reasonable efforts to contact:

  1. The Client;
  2. The Client’s designated local emergency contact;
  3. The pet’s regular veterinarian;
  4. The designated emergency veterinary hospital; and
  5. Another reasonably available veterinary provider or emergency responder.

Love Furry Babies may disclose relevant Client, pet, Property, and incident information to:

  • A veterinarian;
  • An emergency veterinary hospital;
  • An animal ambulance;
  • The emergency contact;
  • Animal control;
  • The fire department;
  • Law enforcement;
  • A property manager; or
  • Another appropriate responder.

16.2 Veterinary Spending Authorization

The Client must select a veterinary-treatment spending limit before service begins.

The Client authorizes a licensed veterinarian to perform examination, diagnostic procedures, emergency stabilization, medication, and other treatment that the veterinarian reasonably considers necessary, up to the selected limit, when the Client and emergency contact cannot be reached promptly.

The Client must select one:

☐ Up to $2,500
☐ No predetermined limit when reasonably necessary to stabilize or protect my pet
☐ Other limit: $________________

The spending limit is an authorization ceiling and not an estimate or guarantee of charges.

Love Furry Babies is not required to personally advance, lend, or guarantee payment.

The Client should keep a valid payment method on file with the regular veterinarian and designated emergency veterinary hospital.

16.3 Financial Responsibility

The Client is solely responsible for all veterinary and emergency costs, including:

  • Examination;
  • Consultation;
  • Diagnostic testing;
  • Medication;
  • Stabilization;
  • Surgery;
  • Hospitalization;
  • Transportation;
  • Animal ambulance;
  • Boarding;
  • Animal-control charges;
  • After-hours fees;
  • Supplies;
  • Locksmith services;
  • Emergency entry;
  • Property repair; and
  • Other expenses reasonably incurred for the pet’s protection.

Love Furry Babies’ involvement in contacting, arranging, or authorizing assistance does not make Love Furry Babies financially responsible.

16.4 No Guarantee

Love Furry Babies does not guarantee:

  • That an illness or injury will be detected;
  • That a veterinarian will be available;
  • That transportation will be available;
  • That treatment will be successful;
  • That a pet will survive; or
  • That veterinary costs will remain within the Client’s selected limit.

16.5 Euthanasia

Love Furry Babies is not authorized to consent to euthanasia unless the Client provides separate and specific written authorization to Love Furry Babies and the treating veterinarian at the time the decision is required.

The Client should establish end-of-life instructions directly with the Client’s veterinarian before an emergency occurs.

17. PET TRANSPORTATION

Until Love Furry Babies obtains appropriate commercial pet-sitting and automobile-related insurance coverage, Love Furry Babies will not ordinarily transport a Client’s pet in a personal vehicle.

When emergency transportation is required, Love Furry Babies may attempt to arrange transportation through:

  • The Client;
  • The Client’s local emergency contact;
  • A family member;
  • Another person authorized by the Client;
  • An animal ambulance;
  • A veterinary transportation provider;
  • The regular veterinarian;
  • An emergency veterinary hospital;
  • Animal control;
  • A fire department;
  • Law enforcement; or
  • Another reasonably available qualified provider.

The Client must designate a local emergency contact who is willing and able to transport the pet.

The Client is responsible for all transportation costs.

Love Furry Babies does not guarantee that emergency transportation will be available.

18. LOCAL EMERGENCY CONTACT

The Client must provide at least one reliable local emergency contact who:

  • Knows the pet;
  • Can access the Property;
  • Has agreed to serve in this role;
  • Can make pet-care decisions;
  • Can assume care;
  • Can transport the pet;
  • Can communicate with a veterinarian; and
  • Can respond when the Client cannot be reached.

The Client authorizes Love Furry Babies to rely on reasonable instructions from the designated emergency contact when the Client cannot be reached.

Love Furry Babies is not responsible for the emergency contact’s failure to:

  • Answer;
  • Respond;
  • Arrive;
  • Transport the pet;
  • Follow instructions;
  • Pay expenses; or
  • Provide continuing care.

19. HOME ACCESS

The Client must provide a safe, working, tested, and approved means of entry.

Approved access methods may include:

  • A secure lockbox;
  • A functioning physical key;
  • A temporary smart-lock code;
  • A door code;
  • A garage code; or
  • Another method accepted in writing.

The Client must test all:

  • Keys;
  • Locks;
  • Doors;
  • Gates;
  • Codes;
  • Alarms;
  • Smart locks;
  • Garage doors; and
  • Entry instructions

before service begins.

Love Furry Babies will not:

  • Force entry;
  • Break a window;
  • Damage a door;
  • Pick a lock;
  • Climb a dangerous fence;
  • Enter through an unsafe opening;
  • Defeat a security system; or
  • Hire a locksmith without authorization, except when directed by an appropriate emergency responder.

20. LOCKBOXES

A secure lockbox located at the Property is the preferred access method.

The Client is responsible for:

  • Purchasing the lockbox;
  • Installing it securely;
  • Maintaining it;
  • Testing it;
  • Providing the correct code;
  • Replacing batteries when applicable; and
  • Confirming that the enclosed key operates the required door.

A lockbox must not be located where Love Furry Babies must:

  • Climb;
  • Enter an unsecured yard containing a loose animal;
  • Reach into a hazardous area;
  • Stand in unsafe traffic;
  • Enter an area with aggressive wildlife; or
  • Take another unreasonable risk.

Love Furry Babies is not responsible for the failure, theft, hacking, malfunction, or deterioration of a Client-provided lockbox unless directly caused by Love Furry Babies’ failure to exercise reasonable care.

21. PHYSICAL KEYS

When Love Furry Babies agrees to retain a physical key:

  • The key will be identified using a coded reference;
  • The Client’s complete address will not intentionally be attached to the key;
  • The key will be stored in a reasonably secure location;
  • The key will be used only for authorized services;
  • The key will not be duplicated without written authorization; and
  • The key will not be intentionally provided to another person except when authorized or reasonably necessary during an emergency.

The Client must not attach the following to a key provided to Love Furry Babies:

  • The complete address;
  • The Client’s complete name;
  • A telephone number;
  • A door code;
  • An alarm code; or
  • Other information identifying the Property.

22. KEY RETURN AND RETENTION

The Client must select one of the following:

☐ Leave the key secured in the Client’s lockbox
☐ Return the key during the final confirmed visit
☐ Arrange an in-person key return
☐ Authorize Love Furry Babies to retain the coded key for future services

Love Furry Babies will not leave a key:

  • Under a doormat;
  • In a mailbox;
  • On a porch;
  • Inside an unlocked container;
  • With an unauthorized person; or
  • In another unsecured location.

A separate trip requested solely to pick up or return a key may be subject to an additional key-handling or travel fee disclosed in advance.

If a key is not retrieved within 30 days after Love Furry Babies requests that the Client arrange its return, Love Furry Babies may:

  • Continue securely storing it;
  • Return it using a trackable method at the Client’s expense; or
  • Destroy it with the Client’s written authorization.

23. SMART LOCKS, DOOR CODES AND ALARM CODES

The Client must provide accurate, current, and tested access codes.

When the system allows it, the Client should create a temporary code specifically for Love Furry Babies rather than sharing a primary household code.

Love Furry Babies will take reasonable steps to:

  • Limit access to Client security information;
  • Protect devices containing security information with passwords;
  • Avoid attaching complete addresses to physical keys;
  • Avoid publicly displaying access information;
  • Store sensitive information only as long as reasonably needed; and
  • Securely delete or dispose of access information when appropriate.

The Client is responsible for disabling temporary codes after services end unless future use has been agreed upon.

No electronic storage system is completely secure. Love Furry Babies does not guarantee against criminal hacking, theft, technology failure, or unauthorized access beyond Love Furry Babies’ reasonable control.

24. FAILED ACCESS

An unsuccessful entry attempt is considered a billable attempted visit when access fails because of:

  • An incorrect key;
  • An incorrect code;
  • A changed lock;
  • A dead smart-lock battery;
  • A defective door;
  • A defective lock;
  • An internal deadbolt;
  • A failed garage door;
  • A power outage;
  • An internet outage;
  • An alarm malfunction;
  • A blocked entrance;
  • A locked internal door;
  • An unsecured aggressive pet;
  • A third party changing the access arrangement; or
  • Another condition outside Love Furry Babies’ reasonable control.

The Client is responsible for resulting:

  • Locksmith fees;
  • Alarm-company fees;
  • Repair charges;
  • Emergency-entry charges;
  • Additional visit fees; and
  • Other related costs.

Love Furry Babies will make reasonable efforts to contact the Client and emergency contact but is not required to remain indefinitely at the Property.

25. LOST OR COMPROMISED KEYS AND CODES

Love Furry Babies will notify the Client promptly after discovering that a retained key or access code may have been lost, stolen, or compromised.

When a physical key is lost directly because Love Furry Babies failed to exercise reasonable care, Love Furry Babies’ responsibility will ordinarily be limited to the reasonable cost of rekeying the affected exterior lock, unless applicable law requires otherwise.

Love Furry Babies is not responsible for a compromised key or code caused by:

  • The Client;
  • A household member;
  • A guest;
  • A contractor;
  • Another caregiver;
  • A defective lockbox;
  • A smart-home provider;
  • Criminal activity;
  • Hacking;
  • Technology failure; or
  • Another circumstance outside Love Furry Babies’ reasonable control.

The Client must promptly change a code that the Client believes may have been compromised.

26. ALARMS, CAMERAS AND RECORDING DEVICES

The Client must disclose all:

  • Indoor cameras;
  • Outdoor cameras;
  • Doorbell cameras;
  • Pet cameras;
  • Audio recorders;
  • Smart speakers capable of recording;
  • Alarm systems;
  • Motion sensors; and
  • Other monitoring or recording equipment

located where Love Furry Babies may perform services.

No recording device may be placed in:

  • A bathroom;
  • A changing area;
  • A designated private area; or
  • Another location where a person would reasonably expect privacy.

The Client is responsible for providing accurate instructions for arming and disarming alarms.

The Client is responsible for charges or consequences resulting from:

  • Incorrect alarm instructions;
  • An undisclosed alarm;
  • A defective alarm;
  • A changed code;
  • A system malfunction; or
  • The Client’s failure to notify the alarm company when required.

Love Furry Babies may document visits and unusual conditions through photographs, videos, timestamps, text messages, emails, and written notes.

27. OTHER PEOPLE AND THIRD PARTIES AT THE PROPERTY

27.1 Mandatory Disclosure

The Client must disclose every person who may be present at or enter the Property during the service period, including:

  • Roommates;
  • Family members;
  • Friends;
  • Neighbors;
  • Guests;
  • Housekeepers;
  • Contractors;
  • Repair workers;
  • Landscapers;
  • Tenants;
  • Home-health workers;
  • Delivery workers with interior access;
  • Dog walkers;
  • Other pet sitters; and
  • Anyone else who may enter or care for the pet.

When reasonably available, the Client must provide:

  • The person’s name;
  • The person’s role;
  • The expected date and time of entry;
  • Whether the person has independent access;
  • Whether the person will provide pet care; and
  • How Love Furry Babies should respond if the person is present.

27.2 Unknown or Unexpected People

Love Furry Babies may:

  • Delay entry;
  • Remain outside;
  • Leave the Property;
  • Contact the Client;
  • Contact the emergency contact;
  • Contact a property manager; or
  • Contact law enforcement

when an unknown or undisclosed person is present or appears to have entered the Property.

Love Furry Babies is not required to enter or remain in a residence with an unknown person or in a situation that reasonably appears unsafe.

A visit delayed or discontinued because the Client failed to disclose another person may be treated as an attempted and billable visit.

27.3 Shared Pet-Care Responsibilities

When another person will feed, medicate, walk, release, confine, or otherwise care for the pet, the Client must provide clear written instructions identifying each person’s responsibilities.

Love Furry Babies is not responsible for:

  • Duplicate feeding;
  • Missed feeding;
  • Duplicate medication;
  • Missed medication;
  • Changed instructions;
  • Open doors;
  • Open gates;
  • Changed alarm settings;
  • Moved supplies;
  • Pet escape;
  • Pet injury;
  • Contamination;
  • Property damage;
  • Missing property; or
  • Other acts or omissions caused by another person.

Love Furry Babies may rely on a written care log, medication chart, message, or other information at the Property but cannot guarantee that another caregiver recorded activities accurately.

27.4 Third-Party Conduct

Love Furry Babies is not responsible for the acts, omissions, negligence, intentional misconduct, or criminal activity of another person entering the Property.

The Client is strongly encouraged not to schedule unfamiliar interior contractors or multiple caregivers during a Love Furry Babies service window.

28. PET CONFINEMENT, FENCES AND EQUIPMENT

The Client must provide safe, clean, functional, and properly fitted equipment, including:

  • Collars;
  • Harnesses;
  • Leashes;
  • Crates;
  • Carriers;
  • Gates;
  • Doors;
  • Windows;
  • Screens;
  • Fences;
  • Food containers;
  • Medication equipment; and
  • Other required pet-care supplies.

Love Furry Babies is not responsible for escape, injury, or loss resulting from defective, damaged, inappropriate, or improperly fitted Client-provided equipment.

Dogs may be released only into a secure area approved during onboarding.

Electronic or invisible fencing alone may be considered insufficient.

Love Furry Babies may decline to release a pet outdoors when:

  • A gate is damaged;
  • A fence is damaged;
  • Contractors are present;
  • Wildlife is present;
  • Another animal is loose;
  • Severe weather is occurring;
  • Standing water is present;
  • Hazardous debris is present; or
  • Another condition creates an unreasonable risk.

29. FEEDING, WATER AND SUPPLIES

The Client must provide enough:

  • Food;
  • Medication;
  • Litter;
  • Waste bags;
  • Cleaning supplies;
  • Treats;
  • Pet-care supplies; and
  • Emergency supplies

for the entire service period, plus a reasonable additional amount.

Love Furry Babies is not responsible when a pet refuses food, water, treats, or medication after the correct items have been offered according to instructions.

Love Furry Babies will not make a significant feeding change without authorization unless reasonably necessary to protect a pet.

The Client is responsible for approved purchases and related travel or service fees.

Love Furry Babies is not required to purchase supplies using personal funds.

30. HOME AND PROPERTY CONDITIONS

The Client must provide a reasonably safe environment.

The Client must disclose:

  • Broken stairs;
  • Loose railings;
  • Unsafe flooring;
  • Aggressive animals;
  • Pest infestations;
  • Mold;
  • Smoke;
  • Gas odor;
  • Exposed wiring;
  • Dangerous chemicals;
  • Unsecured weapons;
  • Illegal substances;
  • Structural damage;
  • Flooding;
  • Surveillance equipment;
  • People staying at the Property; and
  • Any other hazard.

Love Furry Babies may refuse to enter or may immediately leave a Property containing:

  • An unsecured firearm or weapon;
  • Illegal activity;
  • Threatening people;
  • Hazardous chemicals;
  • Fire;
  • Gas odor;
  • Active flooding;
  • Structural instability;
  • Severe infestation;
  • Biohazards;
  • Loose dangerous animals; or
  • Any other unreasonable safety risk.

A visit ended because of an undisclosed or Client-created unsafe condition is considered an attempted and billable visit.

31. WEATHER, DISASTERS AND CIRCUMSTANCES BEYOND CONTROL

Love Furry Babies may delay, shorten, modify, reschedule, or cancel a visit when conditions create an unreasonable risk.

These conditions may include:

  • Hurricanes;
  • Tropical storms;
  • Tornadoes;
  • Tornado warnings;
  • Flooding;
  • Severe thunderstorms;
  • Lightning;
  • Ice;
  • Extreme heat;
  • Road closures;
  • Downed trees;
  • Downed power lines;
  • Fire;
  • Civil emergencies;
  • Police activity;
  • Vehicle failure;
  • Provider illness;
  • Utility failure;
  • Communication failure;
  • Government orders; or
  • Another circumstance outside Love Furry Babies’ reasonable control.

Personal safety takes priority over entering or remaining at an unsafe location.

Love Furry Babies will make reasonable efforts to notify the Client and coordinate alternatives but does not guarantee that an alternative caregiver will be available.

When Love Furry Babies cannot perform a visit for reasons not caused by the Client, the unperformed portion may be refunded or credited as described in the cancellation policy.

32. ACCEPTED PAYMENT METHODS

Love Furry Babies may accept:

  • PayPal;
  • Venmo;
  • Zelle;
  • Cash App;
  • Credit cards;
  • Debit cards; and
  • Cash approved in advance.

Love Furry Babies may add, remove, or temporarily suspend a payment method.

Personal checks are not accepted unless Love Furry Babies agrees otherwise in writing.

Clients must not send:

  • Full credit-card numbers;
  • Bank-account numbers;
  • Financial passwords;
  • Card security codes; or
  • Other sensitive payment information

through ordinary text message or email.

Credit and debit card payments must be completed through an approved payment processor, invoice, or payment link.

33. PAYMENT BEFORE SERVICE

Full payment is required before an Emergency, Same-Day, or Non-Emergency Pet Check-In will be dispatched.

Scheduled services must be paid by the deadline shown on the invoice or booking confirmation.

Cash cannot activate an Emergency or Same-Day dispatch window unless the cash has already been received by Love Furry Babies.

“Payment received” means that Love Furry Babies has confirmed receipt of cleared funds or successful payment authorization.

A screenshot stating that a payment was sent is not proof that payment cleared.

The Client is responsible for:

  • Service fees;
  • Travel fees;
  • Distance fees;
  • Holiday fees;
  • Additional-pet fees;
  • Additional visit time;
  • Approved purchases;
  • Key-handling fees;
  • Locksmith costs;
  • Veterinary expenses;
  • Emergency transportation;
  • Returned-payment fees;
  • Payment disputes;
  • Improper chargebacks; and
  • Other authorized expenses.

34. PAYMENT DOES NOT GUARANTEE ACCEPTANCE

Sending payment does not automatically guarantee service.

A booking is confirmed only after Written Acceptance.

If the Client sends an unrequested payment and Love Furry Babies declines the request before travel or service begins, Love Furry Babies will return the service payment.

Any payment-processing fee that the payment provider does not return to Love Furry Babies may be deducted from the refund.

Love Furry Babies is not responsible for delays caused by:

  • Payment holds;
  • Payment reviews;
  • Incorrect account information;
  • Bank delays;
  • Payment-application failure;
  • Client error; or
  • Fraud screening.

35. CANCELLATION AND REFUND POLICY

35.1 Scheduled Pet Check-Ins: At Least 24 Hours’ Notice

When a Scheduled Pet Check-In is canceled at least 24 hours before the beginning of the scheduled Service Window, the Client may choose:

  • A refund to the original payment method; or
  • An account credit for a future Pet Check-In.

A processing fee that is not returned to Love Furry Babies may be deducted from a refund.

An eligible account credit will be issued for the full eligible amount and must be used within 12 months.

Account credits:

  • Have no cash value;
  • Are not transferable;
  • Cannot be sold; and
  • Expire 12 months after issuance unless Love Furry Babies agrees otherwise in writing.

35.2 Scheduled Pet Check-Ins: Less Than 24 Hours but Before Travel

When a Scheduled Pet Check-In is canceled less than 24 hours before the scheduled Service Window but before Love Furry Babies begins traveling:

  • Love Furry Babies will retain 50% of the affected visit price as a late-cancellation fee; and
  • The remaining 50% may be refunded or applied as an account credit.

35.3 Emergency, Same-Day or Non-Emergency Cancellation Before Travel

When an accepted Emergency, Same-Day, or Non-Emergency Pet Check-In is canceled before Love Furry Babies begins traveling, the Client may receive a refund, less:

  • Nonrefundable payment-processing charges;
  • Purchases specifically authorized for the visit; and
  • Other nonrecoverable expenses already incurred specifically for the request.

The Client may choose an eligible account credit instead.

35.4 Cancellation After Love Furry Babies Begins Traveling

When any visit is canceled after Love Furry Babies begins traveling but before arrival:

  • Love Furry Babies will retain 50% of the visit price; and
  • The remaining 50% may be refunded or applied as an account credit.

35.5 Cancellation After Arrival or Attempted Entry

A visit is nonrefundable after Love Furry Babies:

  • Arrives at the Property;
  • Attempts to enter;
  • Begins performing the service; or
  • Discovers a Client-created condition preventing safe completion.

35.6 No Refund for Client-Caused Service Failure

No refund is required when a visit cannot be completed because of:

  • Incorrect keys;
  • Incorrect access codes;
  • Changed locks;
  • Failed smart locks;
  • Failed alarms;
  • Failure to provide entry;
  • An undisclosed person;
  • An unknown person;
  • Undisclosed pet aggression;
  • Unsafe pet behavior;
  • Incomplete information;
  • Inaccurate information;
  • Unsafe Property conditions;
  • Unsecured weapons;
  • Illegal activity;
  • A request outside the confirmed service scope;
  • The Client returning without notice; or
  • Another material Client violation.

Love Furry Babies may issue a partial credit at its sole discretion but is not required to do so.

35.7 Cancellation by Love Furry Babies

If Love Furry Babies cancels an accepted visit before traveling for a reason not caused by the Client, the Client will receive a full refund for the unperformed visit.

If a visit is interrupted by sudden illness, vehicle failure, severe weather, emergency conditions, or another event outside Love Furry Babies’ reasonable control, Love Furry Babies will refund or credit the unperformed portion when reasonably appropriate.

35.8 Early Return by Client

The Client must notify Love Furry Babies immediately when returning earlier than planned.

Visits already completed, begun, traveled to, or subject to the applicable late-cancellation period remain chargeable.

36. ADDITIONAL VISITS AND CLIENT’S FAILURE TO RETURN

The Client must promptly notify Love Furry Babies when the Client will not return as planned.

Additional visits are not automatic.

Every additional visit depends on:

  • Availability;
  • Written Acceptance;
  • Updated instructions;
  • Continued safe access; and
  • Payment.

Love Furry Babies is not obligated to continue care beyond the confirmed service period.

If the Client cannot be reached and a pet appears to have been abandoned or left without care, Love Furry Babies may contact:

  • The emergency contact;
  • A veterinarian;
  • Animal control;
  • Law enforcement;
  • A landlord;
  • A property manager;
  • A family member; or
  • Another appropriate authority.

The Client is responsible for resulting expenses.

37. PHOTOGRAPHS, VISIT UPDATES AND COMMUNICATIONS

Love Furry Babies will make reasonable efforts to send a visit update after service.

A delayed update does not necessarily mean the visit was not completed.

Updates may be delayed by:

  • Poor cellular service;
  • Internet failure;
  • Platform failure;
  • Power failure;
  • Depleted device batteries;
  • Weather;
  • Safety needs; or
  • Another technical problem.

The Client authorizes service-related communication by:

  • Telephone;
  • Voicemail;
  • Text message;
  • Email; and
  • The communication method used during booking.

Love Furry Babies may photograph or record:

  • The pet;
  • Food and water;
  • Medication;
  • Pet waste;
  • Damage;
  • Access problems;
  • Unsafe conditions;
  • An unexpected person;
  • An open door or gate;
  • Completed services; and
  • Other matters relevant to the visit.

Visit documentation may be retained for:

  • Client updates;
  • Service records;
  • Safety;
  • Dispute resolution;
  • Insurance;
  • Legal compliance; or
  • Defense of a claim.

Love Furry Babies will not use an identifiable photograph of the Client’s home, address, security system, or private information for advertising.

Love Furry Babies will not use photographs of the Client’s pet for public marketing without separate permission.

38. MARKETING CONSENT

Consent to marketing is optional and is not required to purchase Pet Check-In services.

A Client who separately agrees to marketing may receive:

  • Service announcements;
  • Special offers;
  • Discounts;
  • Product news;
  • Newsletter updates; and
  • Love Furry Babies marketing messages.

The Client may unsubscribe at any time.

Service-related messages concerning a booking, payment, emergency, safety issue, or account are not marketing messages.

39. PRIVACY AND INFORMATION SECURITY

Love Furry Babies may collect information reasonably necessary to perform and document services, including:

  • Client contact information;
  • Property address;
  • Pet information;
  • Veterinary information;
  • Emergency contacts;
  • Access instructions;
  • Alarm information;
  • Payment records;
  • Photographs;
  • Visit notes;
  • Electronic acceptance records;
  • Communications; and
  • Incident documentation.

Love Furry Babies will make reasonable efforts to:

  • Limit access to sensitive information;
  • Protect stored information;
  • Avoid attaching full addresses to physical keys;
  • Use password protection;
  • Collect only information reasonably needed;
  • Retain information only as reasonably necessary; and
  • Securely dispose of sensitive information when appropriate.

Love Furry Babies does not knowingly sell Client information.

Information may be disclosed when reasonably necessary to:

  • Perform services;
  • Obtain veterinary assistance;
  • Obtain emergency assistance;
  • Protect a person or animal;
  • Protect Property;
  • Comply with law;
  • Respond to legal process;
  • Collect an unpaid balance;
  • Investigate fraud; or
  • Defend a claim.

No storage or communication system can be guaranteed completely secure.

40. CLIENT PROPERTY AND VALUABLES

The Client should secure:

  • Cash;
  • Jewelry;
  • Firearms;
  • Medications;
  • Financial records;
  • Legal records;
  • Identification documents;
  • Collectibles;
  • Sensitive personal property; and
  • Other valuables

before service begins.

Love Furry Babies is not responsible for unexplained loss, theft, or damage when another person has access to the Property, except to the extent established by reliable evidence and applicable law.

The Client must disclose unsecured weapons or hazardous materials.

Love Furry Babies may refuse entry when a weapon, illegal substance, dangerous chemical, aggressive person, or serious hazard is unsecured or visible.

41. RIGHT TO REFUSE, SUSPEND OR TERMINATE SERVICE

Love Furry Babies may refuse, suspend, or terminate service when:

  • Payment has not been received;
  • The Client provides false information;
  • The Client omits important information;
  • A pet presents an undisclosed danger;
  • The Property is unsafe;
  • Entry is not possible;
  • An unknown person is present;
  • Another caregiver interferes with service;
  • The requested service exceeds the confirmed scope;
  • The Client behaves abusively or threateningly;
  • The Client requests illegal or unsafe conduct;
  • The Client requests medically inappropriate conduct;
  • Continuing service could endanger a person, pet, or Property; or
  • The Client materially violates this Agreement.

Love Furry Babies will make reasonable efforts to notify the Client and emergency contact but is not required to remain in an unsafe situation.

The Client remains responsible for arranging replacement care.

42. NO GUARANTEE OF RESULTS

Love Furry Babies agrees to use reasonable care within the confirmed service scope but does not guarantee:

  • That a pet will eat;
  • That a pet will drink;
  • That a pet will eliminate;
  • That a pet will take medication;
  • That a pet will behave normally;
  • That an illness will be detected;
  • That an injury will be detected;
  • That a pet will not become ill;
  • That a pet will not be injured;
  • That a pet will not escape;
  • That a home system will function;
  • An exact arrival time;
  • Continuous supervision;
  • A particular medical outcome;
  • A particular behavioral outcome; or
  • A particular emotional outcome.

A Pet Check-In is a limited visit and is not a substitute for continuous supervision, professional veterinary care, professional training, or immediate emergency response.

43. ASSUMPTION OF INHERENT RISKS

The Client understands that animals can behave unpredictably even when they have never previously displayed aggression, illness, fear, escape behavior, or destructive behavior.

The Client knowingly assumes the ordinary and inherent risks connected with pet ownership and limited in-home pet-care services, including:

  • Bites;
  • Scratches;
  • Kicks;
  • Sudden animal behavior;
  • Escape;
  • Illness;
  • Sudden medical events;
  • Injury during ordinary movement;
  • Allergic reactions;
  • Ingestion of foreign objects;
  • Wildlife encounters;
  • Weather-related conditions;
  • Pre-existing conditions;
  • Defective Client equipment;
  • Property damage caused by the pet; and
  • Acts or omissions of people other than Love Furry Babies.

The Client understands that a limited Pet Check-In cannot eliminate every risk.

44. RELEASE OF CERTAIN CLAIMS

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH CAROLINA LAW, THE CLIENT RELEASES LOVE FURRY BABIES AND SALLY TAYLOR FROM CLAIMS ARISING FROM:

  1. An animal’s inherent or unpredictable behavior;
  2. A pre-existing medical or behavioral condition;
  3. An undisclosed medical or behavioral condition;
  4. Incomplete, inaccurate, misleading, or outdated Client information;
  5. Defective or improperly fitted Client-provided equipment;
  6. Failed or defective home access;
  7. A defective lockbox, lock, gate, alarm, or smart-home system;
  8. Acts or omissions of another caregiver or third party;
  9. Utility, internet, cellular, payment-system, or alarm failure;
  10. Severe weather, flooding, road closures, disaster, or another event outside Love Furry Babies’ reasonable control;
  11. The Client’s failure to provide adequate supplies;
  12. The Client’s failure to disclose a hazard;
  13. The Client’s failure to arrange a qualified emergency contact;
  14. Veterinary or transportation unavailability; and
  15. Ordinary negligence occurring in connection with the specific inherent or Client-created risks expressly identified in this Agreement, to the extent such claims may lawfully be released.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL OR WANTON MISCONDUCT, INTENTIONAL MISCONDUCT, FRAUD, OR ANY LIABILITY THAT APPLICABLE LAW DOES NOT ALLOW THE PARTIES TO WAIVE.

Nothing in this Agreement eliminates any legal responsibility that cannot lawfully be released.

45. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, when a claim has not otherwise been released:

  1. Love Furry Babies and Sally Taylor will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses;
  2. Love Furry Babies and Sally Taylor will not be liable for lost income, lost opportunity, loss of use, sentimental value, or emotional distress except when applicable law does not permit that limitation; and
  3. The total aggregate liability of Love Furry Babies and Sally Taylor arising from a particular visit or service will not exceed the greater of:
    • The amount paid for the affected service; or
    • Five hundred dollars.

This limitation does not apply to:

  • Gross negligence;
  • Recklessness;
  • Willful or wanton misconduct;
  • Intentional misconduct;
  • Fraud; or
  • Liability that cannot legally be limited.

Each limitation is intended to apply only to the maximum extent permitted by law.

46. CLIENT INDEMNIFICATION

To the maximum extent permitted by law, the Client agrees to defend, indemnify, and hold harmless Love Furry Babies and Sally Taylor from third-party claims, losses, damages, fines, veterinary charges, medical expenses, property damage, and reasonable legal expenses resulting from:

  • The Client’s breach of this Agreement;
  • The Client’s pet biting, attacking, injuring, chasing, or threatening a person or animal;
  • Undisclosed animal behavior;
  • Inaccurate or incomplete information;
  • Unsafe Property conditions;
  • Defective Client equipment;
  • Incorrect instructions;
  • Unsecured weapons;
  • Unauthorized people entering the Property;
  • Another caregiver’s conduct;
  • The Client’s violation of law;
  • The conduct of household members, guests, emergency contacts, contractors, tenants, or other caregivers; or
  • Another matter caused by information, animals, people, or conditions within the Client’s control.

This indemnification does not apply to the extent that a final legal determination establishes that a loss was caused by Love Furry Babies’ or Sally Taylor’s gross negligence, reckless conduct, willful or wanton misconduct, or intentional misconduct.

Nothing in this section removes a responsibility imposed by law that cannot be transferred or waived.

47. CURRENT LACK OF COMMERCIAL PET-SITTING INSURANCE

THE CLIENT ACKNOWLEDGES THAT, AS OF THE EFFECTIVE DATE OF THIS AGREEMENT, LOVE FURRY BABIES AND SALLY TAYLOR DO NOT MAINTAIN COMMERCIAL PET-SITTING LIABILITY INSURANCE, CARE-CUSTODY-OR-CONTROL INSURANCE, OR A PET-SITTER FIDELITY BOND.

The Client acknowledges that:

  1. The Client has been informed of this fact before purchasing services;
  2. Love Furry Babies has not represented that it is insured or bonded;
  3. A service agreement, release, or liability limitation is not insurance;
  4. This disclosure does not eliminate any responsibility imposed by law;
  5. The Client may decline services because of the lack of insurance; and
  6. The Client voluntarily decides whether to purchase services with this knowledge.

Love Furry Babies will update this Agreement and its public representations after obtaining applicable insurance coverage.

48. TEMPORARY SERVICE RESTRICTIONS WHILE UNINSURED

Unless Love Furry Babies provides different written confirmation after obtaining appropriate insurance, Love Furry Babies will not provide:

  • Pet transportation in Sally Taylor’s personal vehicle;
  • Public or neighborhood dog walks;
  • Off-Property pet activities;
  • Off-leash activities;
  • Dog-park visits;
  • Overnight care;
  • Boarding;
  • Administration of injections;
  • Administration of insulin;
  • Intravenous medication;
  • Controlled-substance administration;
  • Complex medical care;
  • Care for pets with a known bite history;
  • Care for pets with a serious attack history;
  • Care for animals classified as dangerous;
  • Care for venomous animals;
  • Care for non-domestic animals;
  • Care for unfamiliar animals without prior onboarding; or
  • Services creating an unreasonable risk.

Love Furry Babies may add, remove, or modify these restrictions after obtaining appropriate insurance, training, any legally required authorization, or professional review.

Any modification applies only after it is provided to the Client in writing.

49. DISPUTE RESOLUTION

Before filing a lawsuit, the parties agree to make a good-faith attempt to resolve the dispute through written communication.

If the matter is not resolved, the parties agree to attempt nonbinding mediation before proceeding in court, except when:

  • Emergency injunctive relief is needed;
  • A legal filing deadline would expire;
  • Debt collection is necessary;
  • A small-claims proceeding is appropriate; or
  • Mediation is otherwise impractical.

Participation in mediation does not require either party to accept a settlement.

50. GOVERNING LAW AND LOCATION

This Agreement is governed by the laws of South Carolina.

Any legal proceeding must be filed in a court with jurisdiction in the South Carolina county where Love Furry Babies maintains its principal place of business, unless applicable law requires another location.

Each party is responsible for its own legal expenses unless a statute, court order, or enforceable written provision provides otherwise.

51. SEVERABILITY

If a provision of this Agreement is found invalid, unlawful, or unenforceable:

  • The provision will be enforced to the maximum lawful extent or removed;
  • The remaining provisions will remain in effect; and
  • The invalid provision will not automatically invalidate the entire Agreement.

52. NO WAIVER

Love Furry Babies’ failure to enforce a provision on one occasion does not waive the right to enforce that provision later.

A courtesy, refund, account credit, schedule adjustment, or exception does not permanently change this Agreement.

53. ENTIRE AGREEMENT

This Agreement, together with:

  • The Client Information Form;
  • The Pet Information Form;
  • The Emergency Authorization;
  • The booking confirmation;
  • The invoice;
  • Accepted written instructions; and
  • Any written service-specific addendum

constitutes the complete agreement between the parties.

Oral statements do not modify this Agreement.

A modification must be in writing and accepted by both parties.

If a booking confirmation directly conflicts with this Agreement, the booking confirmation controls only concerning the specific service term expressly changed.

54. CHANGES TO THIS AGREEMENT

Love Furry Babies may update this Agreement for future services.

A revised Agreement does not automatically change a previously confirmed visit unless:

  • The Client accepts the revision; or
  • The change is required by law or necessary to address an immediate safety concern.

Each version will display an effective date and version number.

The Client must accept the version applicable to the requested service.

55. ELECTRONIC RECORDS AND ACCEPTANCE

The Client agrees to conduct this transaction electronically.

The Client understands that the following may be retained as evidence of acceptance:

  • Checked boxes;
  • Typed legal name;
  • Electronic signature;
  • Form submission;
  • Submission date;
  • Submission time;
  • Internet Protocol address when collected;
  • Payment records;
  • Emails;
  • Text messages; and
  • The Agreement version accepted.

The Client should download, print, or save a copy of this Agreement.

The Client may request an electronic copy by contacting PetCheckIns@LoveFurryBabies.com.

56. SERVICE-RELATED NOTICES

The Client agrees that service-related notices may be sent to the telephone number or email address provided by the Client.

The Client must promptly notify Love Furry Babies of any change to the Client’s:

  • Telephone number;
  • Email address;
  • Service address;
  • Emergency contact;
  • Veterinary provider;
  • Pet information; or
  • Home-access information.

1. Complete Agreement Acceptance — Required

I have read and agree to the Love Furry Babies Pet Check-In Service Agreement, Emergency Authorization, Release and Policies, including the payment, cancellation, emergency-response, pet-safety, home-access, veterinary-care, release, limitation-of-liability, indemnification, and uninsured-service provisions.

2. Booking Is Not Guaranteed — Required

I understand that submitting a form or payment does not guarantee service. My request is confirmed only after Love Furry Babies accepts it in writing, and acceptance depends on location, availability, completed onboarding, payment, safe access, my pet’s needs, and safety considerations.

3. Payment and Dispatch — Required

I understand that full payment is required before an Emergency, Same-Day, or Non-Emergency Pet Check-In is dispatched. Sending payment does not by itself guarantee acceptance.

4. Two-to-Four-Hour Response Window — Required for Emergency Requests

I understand that the two-to-four-hour Emergency Pet Check-In response window is a target, not a guarantee, and begins only after Love Furry Babies has accepted my request in writing, confirmed payment, received completed instructions and authorizations, and confirmed safe access.

5. Immediate Emergency Acknowledgment — Required

I understand that Love Furry Babies is not a veterinarian, animal ambulance, rescue service, fire department, police department, poison-control service, animal-control service, or 911 provider. I will contact the appropriate emergency provider directly when a pet, person, or Property is in immediate danger.

6. Cancellation and Refund Policy — Required

I have read and agree to the cancellation, account-credit, and refund policy. I understand that a visit may become 50% or completely nonrefundable after late cancellation, travel, arrival, attempted entry, or the beginning of service.

7. Veterinary Authorization — Required

I authorize Love Furry Babies to contact my veterinarian, emergency veterinary provider, emergency contact, animal ambulance, animal control, fire department, law enforcement, or another appropriate responder when reasonably necessary to protect my pet, a person, or Property. I accept financial responsibility for all veterinary and emergency expenses.

8. Transportation Limitation — Required

I understand that Love Furry Babies does not currently provide routine pet transportation and will attempt to arrange emergency transportation through me, my emergency contact, an animal ambulance, a veterinary transportation provider, or another appropriate responder.

9. Pet-Temperament Disclosure — Required

I certify that I have truthfully disclosed every known bite, attempted bite, attack, aggression incident, escape, fear trigger, guarding behavior, medical condition, and other behavior that could affect safe service.

10. Right to End Unsafe Service — Required

I understand that Love Furry Babies may modify, shorten, refuse, or immediately end a visit when an animal, person, Property condition, or requested task creates an unreasonable safety risk. An attempted visit may remain billable.

11. Home Access and Key Safety — Required

I certify that all keys, lockboxes, codes, alarms, gates, doors, and access methods I provided are accurate, tested, safe, and functional. I understand that an unsuccessful visit caused by failed access may remain billable.

12. Cameras and Recording Devices — Required

I have disclosed all indoor and outdoor cameras, audio-recording devices, smart speakers capable of recording, alarms, and other monitoring equipment located where Love Furry Babies may perform services.

13. Other Visitors and Caregivers — Required

I have disclosed every person who may be present at or enter my residence during the service period and whether anyone else will care for my pet. I understand that Love Furry Babies may decline to enter or may leave if an unknown or undisclosed person is present.

14. Uninsured-Service Disclosure — Required Until Insurance Is Obtained

I understand that Love Furry Babies and Sally Taylor do not currently maintain commercial pet-sitting liability insurance, care-custody-or-control insurance, or a pet-sitter fidelity bond. I understand that this Agreement is not insurance, and I voluntarily decide whether to purchase services with this knowledge.

15. Electronic Acceptance — Required

I intend my checked boxes, typed legal name, electronic signature, form submission, and payment to constitute my electronic acceptance of this Agreement.

16. Non-Urgent Form Notice — Required

17. Marketing Consent — Optional
